Elijah McClain’s household on Tuesday filed a federal lawsuit alleging the Aurora law enforcement officials and paramedics concerned in his dying violated his constitutional rights.
“Plaintiffs carry this motion in search of each accountability for the profound lack of an exquisite soul, and to make sure that Elijah didn’t die in useless by sending a convincing message that racism and brutality haven’t any place in American regulation enforcement,” the lawsuit states.
The lawsuit names as defendants the town of Aurora, the three Aurora officers who stopped him — Nathan Woodyard, Randy Roedema and Jason Rosenblatt — in addition to 10 different officers, a paramedic and the physician who oversees Aurora Hearth Rescue’s ketamine program.

“Aurora’s unconstitutional conduct on the evening of Aug. 24, 2019, is a component of a bigger customized, coverage, and observe of racism and brutality, as mirrored by its conduct each earlier than and after its homicide of Elijah McClain, a younger Black man,” the lawsuit states.
Aurora law enforcement officials stopped McClain on Aug. 24 after a report of a suspicious particular person. The officers determined to detain McClain and violently compelled him to the bottom and handcuffed him earlier than a paramedic injected McClain with ketamine. McClain suffered cardiac arrest on the way in which to the hospital, the place he was later declared braindead. He died on Aug. 30.
